CHICAGO (CBS) — Cook County prosecutors have dropped murder charges against a woman and her 14-year-old son in the shooting death of a man during a fight in a fast-food restaurant in West Pullman earlier this month.
The decision comes after a video from inside the restaurant shows the man punching the woman several times before he was shot by the teen.
Carlishia Hood, 35, and her son had been charged with first-degree murder in the slaying of 32-year-old Jeremy Brown on June 18 at the Maxwell Street Express located in the 11600 block of South Halsted Street. Hood, who was a valid FOID card and concealed carry license holder at the time of the incident, was also charged with contributing to the delinquency of a minor.

All charges were dropped on Monday. In a statement, Cook County State’s Attorney Kim Foxx’s office said the decision was “based upon our continued review and in light of emerging evidence.”
“Based upon the facts, evidence, and the law we are unable to meet our burden of proof in the prosecution of these cases,” Foxx’s office added.
CBS 2 has obtained cell phone video showing Brown punching Hood three times before her son shot him.
Prosecutors earlier had acknowledged the shooting was caught on video. According to prosecutors, Hood was in line getting food while her son waited inside their car. Shortly after, Brown entered the restaurant.
Both were in line when an argument ensued. Hood started texting and pointing to her son while a witness was laughing and encouraging Brown.
The son arrived at the doorway as the argument turned into a fight with Brown punching Hood in the head three times, according to prosecutors. That’s when the teen pulled out a firearm and shot the victim in the back.
Brown fled the restaurant, but the teen followed him outside. He fired more shots after Hood told him to shoot and kill him, prosecutors said.
He was shot twice in the back and later died from his injuries. It’s unclear why prosecutors decided to charge Hood and her son with murder in the shooting when their account of the shooting noted Brown had punched Hood before her son shot Brown. Prosecutors also acknowledged the shooting was caught on video.
Hood had been ordered held on a $3 million bond after she was charged last week. Her son was charged as a juvenile and was being held without bail.
On Monday, Cook County prosecutors did not elaborate on what evidence led them to drop charges as Hood appeared in court at the Leighton Criminal Courthouse.
Some community activists had called for the charges to be dropped, saying Hood and her son were acting in self-defense after Brown punched Hood during a fight inside the restaurant.
Neither Hood nor her son had a previous criminal record.

CHICAGO — Charges have been dropped against a mother and her 14-year-old son after a fatal shooting in a restaurant in the city’s West Pullman neighborhood June 18.
According to the State’s Attorney’s Office, in light of emerging evidence, the Attorney’s Office has dismissed the charges against Carlisha Hood and her son.
On June 18, Hood entered Maxwell Street Express to get food while her son waited in the car outside.

Shortly after, a man entered the restaurant and an argument ensued between Hood and him, court documents state. Hood allegedly was texting her son from the store, signaling him. He entered the restaurant during the argument.
The argument quickly turned physical when the man punched Hood in the head multiple times. Then, the documents state, Hood’s son displayed a firearm and fired shots at the man. He sustained a gunshot wound to the back.

The man then fled the restaurant where the 14-year-old boy proceeded to follow him and fire more shots.
The man sustained two gunshot wounds to the back and was pronounced dead shortly after.
Both Hood and her son turned themselves in and were arrested on Wednesday and charges were dropped Monday.
Hood and the boy have no reported criminal background and the Attorney’s office said that the evidence and law were unable to meet the burden of proof in the prosecution of the cases.

The office of Cook County State’s Attorney Kim Foxx dropped murder charges against a mother and her son in the June 18 shooting of Jeremy Brown.
Citing “emerging evidence,” prosecutors have dropped murder charges against a woman and her 14-year-old son, less than a week after the woman was accused of ordering her son to kill a man who had punched her at a South Side hot dog stand.
Carlishia Hood, 35, appeared in court Thursday on charges of first-degree murder and contributing to the delinquency of a minor. Judge Barbara Dawkins ordered Hood held on $3 million bail.
Hood’s next court date had been set for next month, but prosecutors scheduled a hearing Monday, when they announced they were dropping all charges. They later announced that murder chargers against the teen have also been dismissed.
“In light of emerging evidence, today the Cook County state’s attorney’s office has moved to dismiss the charges against Carlisha Hood and her 14-year-old son,” the office said in a statement.
“Based upon the facts, evidence and the law, we are unable to meet our burden of proof in the prosecution of these cases,” it added.
The office did not specify what new evidence led to its decision, but it comes after video surfaced over the weekend that appears to show Jeremy Brown, the man who was killed, punching Hood immediately before he was shot June 18.
The video, widely distributed on social media, was apparently shot by a bystander and does not show the shooting. The incident also was captured by high-definition surveillance cameras, officials said.
In presenting their case last week, prosecutors said that Brown, 32, punched Hood in the head at a Maxwell Street Express at 11656 S. Halsted St. after the two got into an argument while waiting in line for food.
Hood texted her son and had him come into the restaurant as the argument turned physical, prosecutors said. The boy took out a gun and shot Brown in his back.
Brown ran from the store as Hood’s son allegedly continued to fire at him. The teen and his mother followed Brown into the parking lot, where she told her son to keep shooting Brown and to kill him, prosecutors said.
Hood also was accused of telling her son to then shoot Brown’s girlfriend and of trying to take the gun from her son afterward. The two left the scene and went home.
Prosecutors said Hood had a valid firearm owners identification card and a concealed carry permit. She had no previous criminal record.
